Bought a male harris some time ago,after much impatient waiting /working on housing,doing courses etc in prep for the new arrival.Spent hrs doing the first manning etc,sitting /standing for hours with a bird on the fist that doesnt want to be on the fist!!??Getting him to eat on the fist blah,blah,you all know how it goes.Got to the bit where he's ready to get some manning in new environments,into new territory and he DIES????
One postmortem l8r it is discovered he was born/hatched with a heart defect and could have died anytime!
On phoning the breeder he sorts me out another bird in a short while,from his cousin who breeds also.Said bird is doing fantastic.I paid for him also,at a reduced rate cos the original breeder obviously,along with his cousin were trying to make up a little for a duff bird!It was also agreed that if the postmortem proved in my favour that a refund would be due(minus the portion to make up for the reduced price of second bird)
This was all six months ago.....several promises of payment later,lots of phone calls to the breeder himself.I really feel he is avoiding paying out for the duff bird.
What do you think?!What should i do??

Lets know who hw is mate, then no one will buy from him and he wont breed reject birds anymore.

Not sure where you stand legally as the bloke coudn't know it had something wrong! But if he then gave his word about the money then he should honour that!! Word is a contract (if you can prove what was said)
So I agree...Name and Shame, if it is IBR registered let them know too. Start telling the world about it and he may start to notice you.
Bad luck about the bird...Good luck getting it sorted !!

be very careful if u name and shame it will give him amo to trun round to you and say well look uv wasted me so ur def not getting money back. just be carefull.

Threaten to name and shame but give him ample warning and a chance to make ammends.Dont rush, put the pressure, on he will pay then, make payment the easy option. Forget the courts to much hassle m8. Forget fighting, only fight over family honour and whos round it is :yawinkle:

I had thought of using the legal system.As you say though it's a pain n lengthy process.Not oly that...i took no receipt as the bloke had an outstanding reputation(or so i first thought!!)
So is it bite the bullet,say goodbye to my money and name n shame him.Or the legal route and small claims court with a little interest thrown in.

I think you should let people know. That way if they buy a bird from him they can get the bird checked out by the vet and save themselves alot of hassle. Doesn't help you but would make you feel better that others aren't going to suffer like you did. Alot of this goes on in the dog world and the only way to sort it is to let people know that their is that problem then the breeder doesn't breed that dog anymore. Good luck Jakki

Hi Mike, I would write him a letter and tell him how you feel. Ask him to respond in 7 to 14 days although he has now had a long time to anyway.

Also state that if the money is a problem, he must let you know how he intends to resolve the matter.

If not take him to the Small Claims Court, it is easy, cheap and then also make it known here and even put an advert in the IBR if you really want to.

Saying all that, I feel there must be some reason this has happened, but just can't think of a reason? You really must speak to him on the phone.

Sorry to here about your bird mate, I had something similar happen to me went into the mews one morning and my FHH was just laid dead on the floor at first i thought heart attack but after reading some of the threads on this forum it appears that some people will even go to the length of poisoning birds ie upset neighbors etc and there would only be 1 person i know that would probably actually try and do this but couldn't prove if that was the case, then i just put it down to me being paranoid and thought it to be a heart attack. I was tempted to get a post mortem but cash was a bit short at the time and wasn't sure how much it cost i have since got had my birds insured (which i should have done in the first place) against theft, death and £5000 vet fees with an excess of £35 to pay on any claim. Just out of interest does nay one know, how much would a post mortem cost roughly? Any info greatly appreciated. :oops::oops: SORRY JUST REALISED THIS POST OF MINE ISNT REALLY ANYTHING TO BREEDERS I WAS JUST READING AND REPLYED PLEASE MOVE POST IF IT CAUSES A PROBLEM. :oops::oops:

id give him a last warning,,then let the public know he is unreliable,,
truth is,you probably dont want a bird from him when he isnt feeling 100% towards you,,he will just give you the ****piest bird he has,,or take it out on you some other way,,
one way to know who is a lousy breeder is this way,, they always breed harris hawks,,,
harris hawks are very easy to breed,and there are scads of inexperienced people breeding them, and pretending to be sombody experienced,, and trustworthy,,
find sombody who breeds somthing else in addition to harris hawks,,who has a good reputation for breeding gos, or longwings,, and you will not be dealing with a "fly by night "breeder
