glad it was thrown out of court. once again wasting time and our money taking these sorts of things to court!!. i stopped taking a knife out with me got one of those multi tools n a pair of scissors!! sorry to go on again but uk is a bloody police state!!! although the media does have a nasty habit of blowing things out of proportion. plus i'm not sayin the falconer did but u dont know if he got stroppy with the coppers or welfare officer

i think the law says you can carry a blade under 3", so that policemen was an idiot. I'm not sure but i think you can carry a larger knife if you can prove you have a valid reason for doing so.

In A word nope it has to have a blae of a certain size and you need to have good reason to carry it :evil: is getting a real joke to be honest not sure if the laws have changed from that though

maybe also just to cover your selfs....ask your local bobby !!! and if he says its" ok " ..then if you do cross one of the idiot coppers you will have some imediate backup to why you are carrying it

Regarding the carrying of knives in public. You are allowed to carry ONE for legitimate purposes say whilst out hunting for paunching rabbits etc, but if you had the knife on you whilst going into a petrol station or picking the kids up from school that could be deemed not to be lawful. The burden of proof is not on the police officer but the person carrying the knife.
The police officer is not an idiot as you put it cold zero. If you want to put it to the test stand on Tuxford market place with a two inch lock knife and use it to pick the crud from under your nails. Reasonable excuse to carry a knife. Don't think so, think you would end up arrested mate.
Lets face it the laws regarding knives are there to protect society from idiots who carry blades to impress others and make themselves look big. Any person carrying a knife on the way to, during, or on the way home fromhunting, fishing or shooting shouldn't have a problem.
If you get stopped by the police and explain why you have the knife I'm sure they will understand, if not complain and take the matter higher as Mr Bain appears to have done.

bod...lot of valid points there !!!....but you have to admit not all coppers use common sense all the time.

surely the fact the courts threw it out , shows that it may have been a little over the top.

Waiste of money like a lot of things these days within the judicial system.

There will always be the jobs worths within the police service who have to justify their existance, but at the end of the day we don't know the full circumstances. When the papers say two pen knifes my immediate thought was why two? I imagine a pen knife like the one I have attached to my car keys with a blade about an inch long. Mr Bain's knives were probably lock knives. Slight difference.
In my hunting jacket I carry two lock knives, a razor sharp one for cutting through skin and flesh and a serrated one for cutting through bone etc. If I was stopped hopefully I could justify having them.

The question regarding the carrying of knives and other offensive weapons is 'subjective'. Trouble is there are police out there who still get wound up if people back chat and then use the law to enforce their position. I've seen plenty of it, believe me and its wrong.

Apart from anything else in England and Wales, I don't know about Scotland a detained person is put before a custody officer who determines if the person has been arrested legitimately. If they have the detained person is normally interviewed and the investigating officer then has to get the approval of the Crown Prosecution Service (CPS)before charging. If the CPS doesn't think there is sufficient evidence to get a succesful prosecution at court the case is dropped there and then. So it appears the CPS or Scotish equivelent, must have thought there was sufficient evidence to take Mr Bain to the Sherrifs Court.

How things are developing in this country with Anti Social Behaviour Laws kids will not be able to play footy on the local park or kick a ball in the street without being subject to an ASBO.
Soon people will be arrested for 'standing on the cracks in the pavement' or 'wearing a loud shirt in public', or 'for having an offensive wife' (Can you remember 'Not the Nine O'Clock News' from the 1980's).

All I can suggest is if you are stopped by Plod explain why you are carrying a knife (don't say its for protection) and just hope you are talking to one of the 'good guys or gals' who does have more than an ounce of common sense. :wink: If not I know of a good solicitor!

im not against knife laws......harsher the better !!!!....... i carry two knives in my hawking jacket all the time....but there again i would,nt wear the jacket around town......

but i am sure there must have been occations when i have filled up with petrol or gone to the cash machine with it on and them in a pocket...
like you have said honus is with myself (and other hunters to boot)... takes a couple of seconds to put the jacket in the boot !!....mind you i would be a little peeeed off if i was arrested say for such a thing and the officer could,nt see it for what it is....and correct the error of the ways rather than persuing... via arrest....cps....and the courts

I'm guilty of wearing my jacket with the knives in the pocket as well Kev. The rosser must have had a bad day!!

Think this thread should be a warning to others though. Imagine the stress of being arrested etc etc.

Bet the Rosser hasn't had his road gritted since.

I have lovely hand made knife my wife got me as a 30th Birthday present, i love to use it whilst out hawking but this subject has played on my mind a lot lately?? sadly its locked in the gunsafe and i carry a leatherman around now instead, i think it is viewed as being a bit more socially acceptable!

Yes it's got a knife on it, but also several other gadgets so i hope the Rossers dont think i'll plier somebody to death?

dont know all the facts.....but i hear they are upping the age from 16 to 18 where you can leagaly buy a knife (even a plastic one from what i gather)...

this once again shows how this government has not thought threw a problem before acting.

we now have a country in which @ 16 you can get married....have a baby...rent a house, but cannot buy cuttlery for another two years !!!

maybe i have got it all wrong....but it shows just how poor they realy are !!
